Reversal Divorce and Family Law

On appeal from a Monroe County Superior Court’s order declining to domesticate a court order from the United Kingdom, the Georgia Court of Appeals ruled in favor of Candace Little’s client in 2022 and reversed the Superior Court, allowing our client’s case to move forward.

    Houston County contempt and adoption dispute, 2022:  When a client’s ex-husband tried to have his ex-wife held in willful contempt of court for disallowing visitation, Nathaniel M. Smith succeeded in arguing in court that our client had not alienated the children from her ex-husband, but the ex-husband had alienated himself; the Judge found our client not to be in willful contempt of court.

    Henry County custody dispute, 2020:  When a client’s ex-wife wanted to move with the client’s children to Florida, Nathaniel M. Smith argued in court that it would not be best for the children to be separated from their father and live primarily with their mother, and the Judge found that it would be best for the children to remain in Georgia with their father if their mother moved to Florida.

    Henry County divorce case, 2022:  Our client’s husband fought for years, avoiding hearings and avoiding service, refusing to comply with the court’s orders, and dragging his feet as much as possible, resulting in a case that lasted for several years — but in the end, Candace Little got her client everything her client wanted and the marital property in the husband’s name was disposed of and divided properly despite the husband’s protests and objections.

  • Not in Contempt Contempt Action

    Henry County contempt action, 2020:  Nathaniel M. Smith’s client’s ex-husband petitioned the Court to find Nathaniel M. Smith’s client to be in contempt of court, asking the court to order Nathaniel M. Smith’s client to pay her ex-husband tens of thousands of dollars.  After a hearing, the Court decided Nathaniel M. Smith’s client was not in contempt of court and she was not ordered to pay anything to her ex-husband.

  • Awarded Custody Divorce

    Coweta County divorce:  Nathaniel M. Smith’s client was awarded primary custody of the children and also alimony, in addition to an equitable share of the marital property.

  • Successfully Defended Custody Modification Action

    Henry County custody modification action:  Nathaniel M. Smith successfully defended against a mother’s attempt to take custody away from a father.

  • Petition Denied TPO Case

    Clayton County TPO case:  Candace Little defended a client against a domestic violence TPO petition our client’s husband filed against her, successfully arguing for the TPO petition to be denied and the ex parte order to be dismissed.

    Newton County:  Candace Cliatt negotiated an alimony award for our client in a divorce action.

  • Favorable Outcome Visitation Dispute

    Pike County:  Nathaniel M. Smith successfully argued for the severe restriction of a father’s visitation with the child in our client’s custody, where the father had demonstrated behavior consistent with drug abuse but denied the allegations.

    Clayton County:  Candace Cliatt defended a client against a paternity suit where the father sought custody of our client’s child, and primary custody was awarded to our client.

  • Dismissed TPO Cases

    Henry County Superior Court TPO cases:  Nathaniel M. Smith defended a client against a TPO (temporary protective order) filed by the mother of our client’s child, and the TPO was dismissed.  Nathaniel represented another client against her ex-husband in another TPO action and the ex-husband’s visitation was suspended.  Nathaniel represented another client against the father of her grandchildren in another TPO action and a TPO issued as the client desired.

    Henry County Superior Court divorce case:  After a day-long trial, Nathaniel M. Smith’s client was awarded the custody she wanted, and a substantial amount of alimony and property because of her spouse’s use of marital assets to support his extra-marital affairs.

  • Favorable Outcome Divorce

    Clayton County Superior Court divorce case:  Nathaniel M. Smith successfully argued at trial that his client should get the marital residence and the four other real estate properties accumulated during the marriage, and all five of those properties were awarded as he requested. No real estate was awarded to the other party.

  • Visitation of Offending Party Stopped Visitation Dispute

    Henry County Superior Court cases:  Nathaniel M. Smith helped ensure visitation was supervised and, in a case where a child suffered harm, succeeded in having the offending parent’s visitation stopped entirely.

  • Visitation of Opposing Party Supervised Visitation Dispute

    Spalding County Superior Court case:  Where the mother of the parties’ minor children showed signs of drug use, Nathaniel M. Smith successfully argued for the father that the mother’s visitation be supervised until clean drug screens were provided to ensure the safety of the children.

  • Favorable Outcome Modification Case

    Henry County Superior Court case:  Nathaniel M. Smith helped in a modification case that resulted in the father of the children losing his rights to visitation and changed the last names of the children to their mother’s last name.

  • Awarded Property Divorce

    Clayton County Superior Court case:  In a divorce action with no minor children, Nathaniel M. Smith successfully represented the Husband, who was awarded all of the property that he asked for at trial.

  • Plaintiff Not Awarded Real Estate Litigation

    Henry County Superior Court case:  Where the Plaintiff sued his neighbors for thousands of dollars over a fence allegedly crossing the property line, Nathaniel M. Smith defended the neighbors in court and the Plaintiff was not awarded any monetary damages against our client.

  • Reduced Business Litigation

    Henry County State Court case:  Where a business dispute arose between the owner of a truck and trailer and the wrecking company that towed the truck and trailer over the amount owed for the towing and towing-related charges, Nathaniel M. Smith successfully argued that the Plaintiff was not entitled to the amount they sought, and after trial the Defendant was ordered to pay less than 25% of the amount the Plaintiff had been demanding.

  • Recall of Arrest Warrant Misdemeanor

    In 2020, Nathaniel Smith helped a client secure the recall of an arrest warrant issued against the client in connection with a Henry County State Court misdemeanor case.

  • Not Guilty Criminal Case

    Henry County State Court case:  Nathaniel M. Smith successfully presented the defendant’s case and argued for the defendant’s innocence to a jury, who found the defendant not guilty of every charge brought against the defendant in that case.

  • No Jail Time Probation

    Henry County State Court case filed:  Nathaniel M. Smith successfully argued against the revocation of the defendant’s probation; the judge allowed the defendant to continue on probation with first offender status intact, with no jail time to be served.

    Clayton County probate matter:  Nathaniel M. Smith successfully argued in court for our client being named as guardian over her aged father over the objections of our client’s sister.

  • Successful Ruling Estate Dispute

    Henry County Probate Court and Superior Court cases filed:  Nathaniel M. Smith successfully defended a client against accusations brought by siblings regarding the estate of their mother.

    In Henry County State Court, Nathaniel Smith successfully defended a woman being sued by a bank over the second mortgage on her ex-husband’s home, bringing the ex-husband into the case and arguing that the ex-husband must be liable and hold the ex-wife harmless pursuant to the settlement agreement from their divorce.

  • Actions Denied Evictions

    Henry County and Clayton County Magistrate Court cases over several years:  Nathaniel M. Smith successfully argued on behalf of landlords for some evictions (dispossessory actions) to occur, and on behalf of tenants for other eviction actions to be denied.

  • Case Dropped Damages

    Superior Court of Pike County case:  Nathaniel M. Smith successfully represented the Defendant against the Plaintiff’s claim for thousands in damages that occurred in a fire; the Plaintiff eventually dropped their case entirely without collecting any sums from the Defendant.
